本條款適用於您使用本系統所涉及之使用者權利與義務、內容利用規範、智慧財產權保護、自動化存取限制及其他相關事項。

二、使用者權利與義務

（一）使用者權利

您於使用本系統時，享有下列權利：

  1. 依佛光山規定合法存取及使用本系統之功能與資源。
  2. 獲得必要之技術支援與協助。
  3. 提出系統改善建議與意見。
  4. 獲得透明之政策說明及資訊安全保障。
  5. 其個人資料依法受到保護。

（二）使用者義務

您於使用本系統時，應遵守中華民國相關法令，包括但不限於《個人資料保護法》、《資通安全管理法》及《著作權法》等規定，不得從事下列行為：

  1. 未經授權存取、干擾或破壞本系統之運作。
  2. 利用本系統從事違法或侵害他人權益之行為。
  3. 散布惡意程式、進行網路攻擊或其他危害資訊安全之行為。
  4. 侵害本系統內容之著作權或其他智慧財產權。

三、本系統宗旨與內容使用原則

本系統設立宗旨在於保存、整理及弘揚星雲大師思想與人間佛教文化，並促進教育推廣、學術研究及社會大眾之合理利用。

本系統所刊載之文字、圖片、影音、資料庫內容及其他相關內容，其著作權及其他智慧財產權均屬佛光山或合法權利人所有，並受相關法令保護。

佛光山鼓勵使用者基於個人研讀、教學、學術研究、非營利文化推廣、評論及引用等目的合理利用本系統內容。使用者於引用、轉載或利用本系統內容時，應適當標示資料來源，尊重其文化價值、學術精神及原意脈絡，不得以歪曲、割裂、斷章取義或其他足以損害原意之方式使用。

除法律另有規定或經權利人書面同意外，任何人不得擅自重製、公開傳輸、改作、散布、出版、販售或作其他商業利用。

四、自動化存取、資料探勘與人工智慧使用限制

為維護本系統之完整性、資訊安全及相關智慧財產權，未經佛光山事先書面同意，任何使用者不得從事下列行為：

  1. 利用網路爬蟲（Web Crawlers）、蜘蛛程式（Spiders）、機器人（Bots）、自動化腳本（Scripts）、資料擷取工具（Scraping Tools）或其他類似技術，以自動化方式存取、擷取、蒐集、複製或下載本系統之內容。
  2. 系統性蒐集、重製、儲存、索引、彙整或重新散布本系統內容之全部或實質部分，以建立資料庫、知識庫、典藏庫、檔案庫或其他衍生性資料集合。
  3. 將本系統所提供之內容（無論全部或部分）用於人工智慧系統、機器學習模型、大型語言模型（Large Language Models）、生成式人工智慧（Generative AI）或其他相關技術之訓練、微調（Fine-tuning）、評估、測試、優化或開發用途。
  4. 建立、散布、授權、販售或以其他方式提供源自本系統內容之資料集（Datasets），供商業或非商業之人工智慧、機器學習或自動化分析用途使用。
  5. 規避、破解或試圖規避佛光山所設置之技術保護措施，以進行未經授權之自動化存取、複製、下載或重製行為。

對於前項限制，佛光山得依申請個案審酌，核准非營利性之學術研究機構或研究人員進行文字與資料探勘或其他相關學術研究。

對於疑似違反本條規定之行為，佛光山得採取必要之法律及技術措施，包括但不限於限制系統存取權限、停止使用資格，並依法追究相關責任。

五、免責聲明

（一）系統可用性

佛光山致力於維持本系統之正常運作，惟不保證系統服務不中斷、即時或完全無誤。佛光山保留維護、更新、修改或暫停系統服務之權利。

（二）資料正確性

本系統所提供之資料係供文化保存、教育推廣及學術研究參考之用。使用者於引用、轉載或利用相關內容時，應依實際需求自行判斷，並適當參考原始資料來源。

六、使用條款修訂

佛光山得因法令變更、技術發展或營運需求，隨時修訂本條款內容。修訂後之版本將公告於本系統，自公告日起生效，不另行個別通知。

Welcome to the Venerable Master Hsing Yun Digital Archives (the "System"), provided by Fo Guang Shan Monastery ("Fo Guang Shan").

 

To regulate the use of the System, safeguard users' rights and interests, and maintain the proper operation of the System and its contents, Fo Guang Shan has established these Terms of Use ("Terms").

 

Please read these Terms carefully to understand the rules governing your use of the System, your rights and obligations as a user, and other important information. By accessing or using the System, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

 

1. Scope

These Terms govern your use of the System, including your rights and obligations as a user, the permitted use of the System's contents, intellectual property protection, restrictions on automated access, and other related matters.

 

2. User Rights and Obligations

(A) User Rights

When using the System, you are entitled to:

(1) Access and use the System's functions and resources in accordance with Fo Guang Shan's regulations.

(2) Receive necessary technical support and assistance.

(3) Submit suggestions and recommendations for improving the System.

(4) Receive transparent policy information and appropriate information security protection.

(5) Have your personal data protected in accordance with applicable laws.

 

(B) User Obligations

When using the System, you shall comply with all applicable laws and regulations of the Republic of China (Taiwan), including but not limited to the Personal Data Protection Act, the Cyber Security Management Act, and the Copyright Act, and shall not engage in any of the following activities:

(1) Accessing, interfering with, or disrupting the operation of the System without authorization.

(2) Using the System for any unlawful purpose or in any manner that infringes upon the rights or interests of others.

(3) Distributing malicious software, conducting cyberattacks, or engaging in any activity that compromises information security.

(4) Infringing the copyrights or other intellectual property rights associated with the contents of the System.

 

3. Purpose of the System and Principles Governing the Use of Content

The System is established to preserve, organize, and promote the thought of Venerable Master Hsing Yun and Humanistic Buddhism, while facilitating educational activities, academic research, and the reasonable use of its contents by the public.

All texts, images, audiovisual materials, database contents, and other materials made available through the System are protected by copyright and other intellectual property rights owned by Fo Guang Shan or their respective lawful rights holders and are protected by applicable laws.

Fo Guang Shan encourages users to make reasonable use of the System's contents for purposes such as personal study, teaching, academic research, non-profit cultural promotion, commentary, and quotation. When quoting, reproducing, or otherwise using the contents of the System, users shall properly acknowledge the source, respect the cultural value, academic integrity, and original context of the materials, and shall not distort, fragment, misrepresent, or otherwise present the contents in a manner that alters or harms their original meaning.

Unless otherwise permitted by law or with the prior written consent of the rights holder, no person may reproduce, publicly transmit, adapt, distribute, publish, sell, or otherwise commercially exploit the contents of the System.

 

4. Restrictions on Automated Access, Text and Data Mining, and Artificial Intelligence

To protect the integrity, information security, and intellectual property of the System, no user may, without the prior written consent of Fo Guang Shan, engage in any of the following activities:

(1) Using web crawlers, spiders, bots, automated scripts, scraping tools, or any similar technologies to automatically access, retrieve, collect, copy, or download the contents of the System.

(2) Systematically collecting, reproducing, storing, indexing, compiling, or redistributing all or any substantial portion of the System's contents for the purpose of creating databases, knowledge bases, digital repositories, archives, or other derivative collections.

(3) Using any part or all of the System's contents for the training, fine-tuning, evaluation, testing, optimization, or development of artificial intelligence systems, machine learning models, large language models (LLMs), generative artificial intelligence systems, or any related technologies.

(4) Creating, distributing, licensing, selling, or otherwise making available datasets derived from the System's contents for commercial or non-commercial artificial intelligence, machine learning, or automated analytical purposes.

(5) Circumventing, bypassing, or attempting to circumvent any technological protection measures implemented by Fo Guang Shan for the purpose of unauthorized automated access, copying, downloading, or reproduction.

Notwithstanding the foregoing restrictions, Fo Guang Shan may, upon review of individual applications, authorize non-profit academic institutions or researchers to conduct Text and Data Mining (TDM) or other related academic research.

Where Fo Guang Shan reasonably believes that these Terms have been violated, it may take appropriate legal and technical measures, including but not limited to restricting access to the System, suspending usage privileges, and pursuing legal remedies where appropriate.

 

5. Disclaimer

(A) System Availability

Fo Guang Shan endeavors to maintain the normal operation of the System. However, it does not guarantee that the System will be uninterrupted, continuously available, timely, or entirely error-free. Fo Guang Shan reserves the right to maintain, update, modify, or suspend the System at any time.

(B) Accuracy of Information

The contents provided through the System are intended for cultural preservation, educational purposes, and academic research. Users are responsible for exercising their own judgment when quoting, reproducing, or otherwise using the materials and should consult the original sources where appropriate.

 

6. Amendments to the Terms

Fo Guang Shan reserves the right to amend these Terms at any time in response to changes in applicable laws, technological developments, or operational requirements. Revised versions will be published on the System and shall become effective upon publication without further individual notice.
